Terms and Conditions of Sale
1. General Provisions
1.1. These online store rules (hereinafter – the Rules) are a legally binding document for the Buyer and the Seller (hereinafter – the Seller), which establishes the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend, or supplement these Rules at any time. The Buyer is informed about changes to the Rules on the online store's website.
2. Formation of the Purchase and Sale Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the online store after having read these rules.
3. Seller's Rights
3.1. In the event of significant circumstances, the Seller may temporarily or completely suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the online store or violates their obligations, the Seller has the right to restrict or suspend their access to the online store without warning.
4. Seller's Obligations
4.1. The Seller undertakes to provide the opportunity to use the services of the online store, the operating conditions of which are determined by these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, based on the conditions set forth in these purchase and sale Rules.
4.3. When, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the Purchase and Sale Agreement after informing the Buyer. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund the paid money within 3 business days.
4.4. Once the Buyer exercises the right provided for in clause 5.2 of the Rules, the Seller undertakes to refund the money paid by the Buyer within 5 (five) business days from the date of receipt of the returned goods..
4.5. The Seller may withhold the refund of the amount paid by the Buyer until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.
5. Buyer's Rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the purchase and sale agreement for goods concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right discussed in clause 5.2 only if the product has not been damaged or its appearance has not substantially changed, and if it has not been used.
6. Buyer's Obligations
6.1. The Buyer must pay for the purchased goods and accept them in the manner provided for in these Rules.
6.2. If the Buyer, during the delivery of the goods, refuses to accept the goods without valid reasons, the Buyer must cover the return shipping costs upon the Seller's request.
6.3. At the time of delivery of the goods to the Buyer, the Buyer must, together with the Seller or the person who delivered the shipment, check the condition of the shipment and the product(s).
6.4. By using the online store, the Buyer confirms that they agree to these purchase and sale rules and must comply with them.
7. Product Prices
7.1. Product prices in the online store are indicated in euros. Prices include VAT. After confirming the order, a delivery fee is added to the total amount of the goods, if applicable.
8. Ordering and Payment for Goods
8.1. After visiting the online store, the Buyer selects the goods they like and adds them to the shopping cart. After forming the shopping cart, the Buyer enters the personal data necessary for the execution of the order: their name, surname, address where the goods will be delivered, phone number, and additional information that may be important for delivering the ordered goods. The Buyer confirms that they have read these rules and confirms the order.
8.3. Payment can be made using the electronic banking services of Swed, Seb, Luminor, Citadele, and Šiaulių bankas, as well as Visa / MasterCard payment cards. Payments are possible in the euro currency. Payments are processed using the MakeCommerce.lt payment platform.
9. Delivery of Goods
9.1. When ordering goods, the Buyer must provide the exact delivery address.
9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods personally, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding the delivery of the goods to an improper person.
9.3. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions.
9.4. The features of all goods sold are indicated in the description accompanying each product. The Seller is not responsible for the fact that the color, shape, or other parameters of the goods in the online store may not correspond to the actual size, shape, and color of the goods due to the characteristics of the monitor used by the Buyer.
9.5. If the Buyer withdraws from the purchase and sale agreement for the goods, all amounts paid by the Buyer, including the delivery costs paid by the Buyer, will be refunded to the Buyer.
10. Return of Goods
10.1. Quality goods can be returned within 14 days from the date of their receipt. Defects in sold non-quality goods are remedied, and non-quality goods are replaced or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, it is necessary to comply with the following conditions:
10.2.1. The returned product must be in its original, neat packaging (this clause does not apply in the case of returning a non-quality product);
10.2.2. The product must not have been damaged by the Buyer;
10.2.3. The product must be unused and must not have lost its commercial appearance: labels must be intact, protective films must not have been removed, etc. (this clause does not apply in the case of returning a non-quality product);
10.2.4. The returned product must be in the same configuration as received by the Buyer (this clause does not apply in the case of returning a non-quality product);
10.2.5. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning goods were not followed;
10.2.6. The return of goods is carried out in the manner determined by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in the case of a non-quality product - in such a case, the return of goods is carried out within the statutory warranty period);
10.3. The return and exchange of quality goods are carried out in accordance with Article 6.22810, Part 1 of the Civil Code;
10.4. Money paid for goods accepted by the Buyer but later returned is refunded to the Buyer's account no later than 5 (five) days from the date of return of the product to the Seller, unless the Seller and the Buyer agree otherwise.
11. Final Provisions
11.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
11.2. These Rules and the relationships between the Parties regarding these Rules are applied and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disagreements arising from the execution of these Rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties are released from the obligation to fulfill these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force Majeure).
